3. Eligibility

To use CalmMix, you must:

• Have a compatible iOS device
• Agree to these Terms and our Privacy Policy

By using the App, you represent that you meet these eligibility requirements.

4. License and App Store Terms

4.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Use the App for personal, non-commercial purposes
• Access the content and features provided through the App

4.2 App Store Terms

The App is available through the Apple App Store. Your use of the App is also subject to Apple's App Store Terms of Service. We are not responsible for Apple's policies or actions.

5. User Accounts and Data

CalmMix works without requiring user registration. All data is stored locally on your device.

5.2 Data Storage

• Local Storage: Custom mixes, favorites, and settings are stored on your device
• iCloud Sync: Optional syncing of saved mixes via iCloud (if enabled)
• Analytics: Usage data may be collected for app improvement (see Privacy Policy)

6. In-App Purchases and Premium Features

6.1 Premium Features

CalmMix offers optional premium features through in-app purchases, including:

• Ad-free experience
• Advanced sound packs
• Premium sound categories
• Enhanced customization options

6.2 Payment Terms

• All purchases are processed through Apple's App Store
• Payments are non-refundable except as required by applicable law
• Subscription auto-renewal can be managed in your App Store account settings
• Prices may change at any time with notice

6.3 Free Features

The core functionality of CalmMix, including AI mixing, basic sound library, sleep timer, and custom mix creation, remains free to use.

7. User Conduct and Prohibited Uses

7.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

7.2 Prohibited Activities

You may not:

• Use the App for any illegal or unauthorized purpose
• Modify, reverse engineer, or attempt to extract the App's source code
• Distribute or share the App without authorization
• Use the App in a way that could damage, disable, or impair our services
• Violate any applicable laws or regulations
• Infringe on intellectual property rights

9.2 User-Generated Content

Custom mixes you create remain your property. By using the App, you grant us a limited license to store and process your mixes as necessary for app functionality.

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

12. Termination

You may stop using the App at any time by deleting it from your device.

Upon termination:

• Local data on your device remains accessible
• These Terms continue to apply to prior use

Your continued use of the App after changes constitutes acceptance of the new Terms.
